These are the terms and conditions under which the CheckPlan.co.uk Service is provided by Foyle Technologies Ltd. These are the conditions you must adhere to if you want to subscribe to Foyle Technologies' services. We are Foyle Technologies Ltd., any reference to "us", or "we" in this Agreement shall be read as reference to Foyle Technologies Ltd. By leaving the acceptance check box below ticked you indicate your acceptance of this Agreement, you ("Subscriber") accept all of the Terms & Conditions described herein. If you do not agree to these Terms & Conditions click to remove the check from the accept terms box.

This Agreement shall be effective on the date that you first indicate acceptance of the terms of this Agreement ("Effective Date").

(a) CheckPlan.co.uk: If you subscribe to the CheckPlan.co.uk Service, the CheckPlan.co.uk Service will always remain the property of Foyle Technologies Ltd.

(b) We can withdraw any advertised Service. We can change or reduce the hours that these Services are available.

(a) Your Username and Password will give you access to the CheckPlan.co.uk Service. Having a Username and Password does not automatically entitle you to access any of the CheckPlan.co.uk Services. A company will be entitled to as many Usernames and Passwords as it subscribes to.

(b) If you give your Username and Password to a third party it could make its use invalid.

(c) If CheckPlan.co.uk believes that a Username and Password has been used in breach of these terms and conditions, we may without prior notice; remove the right of access for this Username and Password.

We will not be liable under this Agreement for:

(a) Any fault in your hardware or software, or any apparatus that you use to receive our Services;

(b) Any fault in your Username and Password arising by you tampering with it, your negligence or failure to follow our instructions;

(c) Our failure to provide the Services caused by events outside our reasonable control;

(f) Any loss or damage caused by us or our employees or agents in circumstances where;

1. There is no breach of the legal duty of care owned to you by us or by any of our employees or agents;
2. Such loss or damage is not a reasonably foreseeable result of any such breach;
3. Any increase in loss or damaged results from breach by you of any term of this Agreement.

Plans that are provided by CheckPlan.co.uk in response to a Markup Request are subject to the copyright terms and conditions of the plan provider.

Subscriber warrants that the Subscriber Proprietary Information sent to Foyle Technologies has been legally obtained, that Subscriber's subsequent use of such information will be legal, and that, to the best of its knowledge, none of the activities for which it has engaged the Services of Foyle Technologies will involve the commission by Foyle Technologies of any illegal act.

Foyle Technologies makes no warranties, express or implied, hereunder with respect to the services, data or the media on which the data is provided, including but not limited to warranties of accuracy, completeness, currentness, merchantability or fitness for a particular purpose.
